Judge Burroughs cited the Supreme Court ruling in June that found the federal judiciary lacked authority to review TPS determinations by DHS.
U.S. District Judge Allison Burroughs lifted the administrative stay she had placed on the Department of Homeland Security’s (DHS) removal of Temporary Protected Status (TPS) for Somali nationals in the U.S. The judge issued the ruling following a Supreme Court decision that determined the federal judiciary did not have the power to review DHS’ terminations of TPS for Haitians and Syrians.
Judge Burroughs referenced the high court ruling, though she stated, “Plaintiffs have made a convincing showing that they will suffer irreparable harm if the injunction is withheld… and the balance of hardships and the public interest also favor Plaintiffs, given that the government has made no showing that maintaining TPS status for the duration of this litigation would impose an undue burden.”
In June, Supreme Court Justice Samuel Alito wrote the decision, stating that lower courts had exceeded their authority in ruling against the president’s administration and that federal law “expressly restricts” courts from reviewing DHS decisions to end or extend TPS protections.
